The HVAC Compliance Handbook: Permits, Licenses & EPA 608 (2026)
A field-service owner's guide to staying compliant: the four layers of HVAC compliance, what actually expires, and how to stop tracking it in a spreadsheet that nobody opens.
Compliance is the part of running a field service business that generates zero revenue when you get it right and can cost you a fortune when you get it wrong. A single lapsed license can void a permit, fail an inspection, kill a manufacturer warranty on equipment your customer just paid for, and hand them a reason not to pay you. And it almost never fails loudly. You find out weeks later, when it’s expensive.
The good news: HVAC compliance isn’t complicated once you see its structure. It’s four layers, and once you know what lives in each one (and which parts actually expire), staying covered becomes a system instead of a scramble.
The four layers of field-service compliance
Think of everything you have to stay on top of as four stacked layers:
- Federal certification: EPA Section 608, for anyone who handles refrigerant.
- State & local licensing: contractor, journeyman/master, and business licenses.
- Per-job permits & inspections: pulled and closed on individual jobs.
- Manufacturer & warranty requirements: the strings attached to the equipment you install.
Most shops obsess over Layer 1 (which barely changes) and lose track of Layers 2 and 3 (which change constantly). Let’s walk each one.
Layer 1: EPA Section 608 (federal)
Section 608 of the Clean Air Act requires anyone who maintains, services, repairs, or disposes of equipment that could release refrigerant to be certified. There are four certification types: Type I (small appliances), Type II (high-pressure, i.e. most residential and light-commercial AC), Type III (low-pressure chillers), and Universal (all three).
Here’s the part that trips people up: EPA 608 certification does not expire. Pass the exam once and it’s valid for life: no renewal, no continuing education. So why do shops lose coverage? Because “the cert is permanent” is only half the story. The half that bites you is your ability to prove it, and the state licenses that stack on top of it.

Layer 2: State & local licensing (this is where shops actually get burned)
Unlike 608, state and local licenses almost always expire (typically every one to three years), and requirements vary wildly by state and municipality. Depending on where you operate you may need to track:
- A state HVAC/mechanical contractor license (often held at the company or qualifying-party level)
- Journeyman and master licenses for individual techs
- A local business license or registration in each city or county you work in
- Refrigerant handling or trade-specific licenses layered on top of 608 in some states
This is the layer that fails silently. The contractor license renewal notice goes to an email nobody checks; the city business license lapses because it renews on a different calendar than everything else. Then a permit gets rejected or an inspector asks for a license number that’s no longer valid, and the job stops.
Layer 3: Permits & inspections (per job)
Most installs and many repairs require a permit (mechanical, electrical, gas, plumbing, or building) pulled from the local jurisdiction before work begins, and closed out after inspection. A permit moves through a lifecycle: draft → applied → issued → inspected → closed. Miss the inspection window or lose the paperwork and you’ve got an open permit hanging over a completed job.
The operational failure here is the handoff: the office pulls the permit, the tech does the work, and the issued permit or inspection result never makes it back into the record. Months later, an open permit surfaces on a property sale or a follow-up job.

Layer 4: Manufacturer & warranty requirements
Every piece of equipment you install comes with warranty conditions, and some of them are compliance obligations in disguise:
- Proof of a licensed, 608-certified installer on file
- Registration of the equipment within a set window (often 60 to 90 days)
- Installation to code, sometimes verified by permit and inspection
Miss one and the manufacturer can deny a warranty claim, which means you eat the repair, or worse, the relationship with the customer. Warranty compliance quietly depends on Layers 1 to 3 all being in order.
The real problem: nothing tells you a deadline is coming
Notice the pattern across all four layers. The certification that never expires is the one everybody watches. The things that do expire (state licenses, business licenses, permits, registration windows) are scattered across different calendars, different agencies, and different inboxes. No single system is watching them, so you find out one lapsed when something breaks.
The typical tracking method (a spreadsheet, a filing cabinet, or the office manager’s memory) shares one fatal flaw: it’s passive. It only helps if someone remembers to open it. When your office manager is slammed (always), the reminders that matter never fire.
